Welcome to Dailybetes. By downloading, installing, or using the Dailybetes mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Dailybetes is a diabetic nutrition tracking application that provides tools for carbohydrate counting, glycemic index information, food scanning, glucose tracking, and general nutrition guidance. The App is designed as an informational and tracking tool and is not intended to replace professional medical advice, diagnosis, or treatment.

3. Medical Disclaimer

The App does not provide medical advice. All content, including but not limited to nutritional information, glycemic index values, A1C estimations, blood sugar pattern analysis, and AI-generated recommendations, is provided for informational and educational purposes only. You should always consult with a qualified healthcare professional, such as your endocrinologist or registered dietitian, before making any changes to your diabetes management plan.

The App is not a substitute for professional medical care. Never disregard professional medical advice or delay seeking it because of information provided by the App.

4. Subscriptions and Payments

Dailybetes offers a premium subscription ("Dailybetes Premium") that provides access to additional features. By subscribing:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews unless canceled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• You can manage or cancel your subscription at any time through your App Store account settings.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

5. User Accounts

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse engineer, decompile, or disassemble the App.
• Interfere with or disrupt the App's servers, networks, or infrastructure.
• Upload or transmit any harmful, offensive, or infringing content.
• Use the App to collect personal information about other users without their consent.

7. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio, and software, are the exclusive property of Dailybetes and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

8. AI-Generated Content

The App uses artificial intelligence to provide food analysis, nutrition recommendations, and chat-based guidance. AI-generated content may not always be accurate and should be verified independently. We do not guarantee the accuracy, completeness, or reliability of AI-generated content. All AI-generated health information references published medical sources including the American Diabetes Association, USDA, and World Health Organization.

9. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in the Privacy Policy.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Dailybetes and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, health complications, or financial losses, arising out of or related to your use of the App.

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Indemnification

You agree to indemnify and hold harmless Dailybetes and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms within the App or on our website. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions.
